Terms and Conditions of Hire
1. RESTRICTIONS: The Hirer/Driver (a)
Hirers/Drivers must not have been convicted of driving a vehicle under the
influence of drugs or over the legal limit of alcohol, nor tow the Camper
Trailer while under the influence of either. (b) Hirer/Driver must be
21years and over (c) Hirer/Drivers must have Full Comprehensive
Insurance for the towing vehicle and a Certificate of Currency from their
Insurance Company supplied to Habitat Camper Trailer Hire (the
Owner) (d) Hirer/Driver must not have been refused any motor vehicle
insurance (e) No article whatsoever is to be tied or carried on the
galvanised Roof Rack of the Camp/O/Matic Camper Trailer at any time during
the hire period. Failure to adhere to this clause will forfeit the total
bond. (f) Care and Security of the Camper Trailer Hirer/Drivers Accept
Full Responsibility for the Care and Security of the Camper Trailer and
included Equipment at All Times.
2. RESTRICTED
AREAS: (a) The Jayco ‘On Road’ trailers are to be driven at
all times on sealed/bitumen roads. The only exception to this is where the
Camper Trailer exits a sealed road directly into a National Park only on
formed roads deemed suitable by that authority for 2 wheel drive vehicles
and in consideration of the current weather conditions. The camper trailer
is permitted to visit Kangaroo Island (SA) (b) The Camp/O/Matic 4 x 4
Camper Trailer and Cobb & Co 4 x 4 Camper Trailer can also be driven
on recognised tracks but shall not be taken to restricted areas as defined
by Habitat Camper Trailer Hire. Restricted areas consist of Cape York
-covering all area north of Cairns, Simpson Desert, Canning Stock Route,
Gun Barrel Highway, Oodnadetta Track, Birdsville Track, Tanami Track and
Gibb River Road or any areas deemed impassible by Habitat Camper Trailer
Hire or Local authorities (as signposted) or into areas where named
cyclone(s) is affecting. (c) Should either applicable clause to the
Hirer of the contract be broken, Habitat Camper Trailer Hire retain the
right to charge the Hirer with all costs relating to damages and recovery
costs of unit as well as right to retain the bond in full for breach of
this agreement.
3. TERMS OF PAYMENT: (a)
Booking Deposit The Booking deposit is $110- Payment of this deposit
confirms the Hirers reservation for the designated period & is non
refundable. (b) Hire Fee & Bond. Total Hire Fee and Bond to be paid
1 month prior to hire departure. If hire is organised within that period,
payment by personal cheque is only acceptable within 14 days of hire
collection date, otherwise a bank cheque, postal note or cash will be
required (c) Refund of Bond. The Security Bond is fully refundable
within 7 working days at completion of Hire provided the Camper Trailer is
returned on time, undamaged and the LPG Bottles are filled. (d) In the
event of an accident requiring claim against the owners Insurance, the
Bond is forfeited in total. (e) Cleaning Fee The Camper Trailer is to
be returned in a clean condition at the completion of Hire (f) If the
unit is not cleaned satisfactorily, the cleaning fee commences at $40.00.
We reserve the right to retain a minimum of $40.00 to a maximum of
$100.00 (g) Habitat Camper Trailer Hire reserves the right to cancel
any hire if Hirer contravenes these conditions. (h) Cancellation Fee If
cancelled:- Within 25 days prior to pick up No Fee From 24 to 8 days
prior to pick up 15%Gross Rental 7 days and less prior to departure 40%
Gross Rental No Show 40% Gross Rental Early Return for any reason
whatsoever No refund.
4. BREAKDOWNS: (a) In
the event of a breakdown, the owner (Habitat Camper Trailer Hire) must be
notified as soon as practically possible. (b) The owner (Habitat Camper
Trailer Hire) shall not be liable for any expenditure, damage, loss or
inconvenience incurred by the Hirer arising out of any breakdown to the
Camper Trailer whether caused by fair wear and tear or any reason
whatsoever. (c) In the event of a breakdown the Hirer is responsible
for the security and care of the Camper Trailer and its Equipment as
stated Clause 1(f)
5. DAMAGE TO TRAILER: (a)
If any damage does occur your entire Bond will be retained to cover
costs. (b) There is to be absolutely nothing packed or tied to the top
or any part of the Camper Trailer. Refer 1(e) (c) There is to be
nothing hard eg. boxes, Esky or the like to be stored in the Camper
Trailer when it is erected that may mark or damage the floor or fittings
and no LPG gas heaters to be used inside the camper trailer. (d)
Camp/O/Matic ‘Getaway’ No boxes (ie Beer carton or hard items -placed on
the rear shelf of the ‘Getaway’ unit while travelling. (e) Jayco Camper
Trailer. No heavy/hard items to be stored on the floor of the ‘Hawk’ or
‘Finch’ whilst travelling (f) The camper trailer is not to be tampered
with or altered in any way. (g) No substitution of any item of (or
included in) the camper trailer is to be made. (h) Any damage to Tyres
and Rims (outside normal wear and tear) will be at the cost of the hirer
and deducted from bond. (i) Missing Items. The cost of any missing,
broken, lost or substituted items is deducted from the bond (j)
Malicious Damage by Hirer. Any malicious damage incurred to the Camper
Trailer by the Hirer is the full financial responsibility of the Hirer
plus any fees incurred in recovering those costs of either replacement or
repair of damage caused by Hirer or persons involved in causing such
damage which comes under Clause 1(f)
6. ACCIDENT INVOLVING
CAMPER TRAILER: (a) Hirer must make a report to Police
regarding any accident involving the Camper Trailer; Malicious Damage
caused to the Camper Trailer; Theft of the Camper Trailer or equipment
belonging to the Camper Trailer. (b) In the event of an accident
involving another vehicle the Hirer is required to obtain; the
registration, make, model & colour of the other vehicle. The name,
address and drivers licence details of the other party involved; the name
and address of any witness and forward these details to the Police &
Habitat Campers. (c) The Hirer indemnify Habitat Camper Trailer Hire
of all damage to persons & property in relation to the Hirers use and
control of the Camper Trailer
7. SUB LETTING: The
Hirer is not permitted to sub lease or lend the Camper Trailer to any
other persons.
8. LATE RETURNS: A penalty rate
will apply to late returns at $50-00 per day or part thereof and/or loss
of bond if late return jeopardises another booking.
9.
GENERAL: Habitat Camper Trailer Hire will not bear liability for
any property stolen, or left in Camper Trailer during or after hire
period. No Pets are permitted in the Camper.
